Please read these Terms of Service (“Terms”) carefully before using www.kickincustoms.com (the “Website”) operated by Kickin’ Customs LLC, a Massachusetts limited liability company (“Kickin’ Customs,” “we,” “us,” or “our”). These Terms govern your use of our Website and your relationship with us as a client or visitor. By using our Website or booking any service, you agree to be bound by these Terms. If you do not agree to these Terms, you are not permitted to access or use the Website.

Kickin’ Customs provides professional automotive customization services including, but not limited to:

  • Paint Protection Film (PPF)
  • Ceramic Coatings
  • Window Tint
  • Vinyl Wraps (Cosmetic, Commercial, Color Change, etc.)
  • Windshield Protection Film
  • Residential & Commercial Films
  • Remote Starts, GPS, Dashcams and Alarm Installation
  • Additional detailing and enhancement services

All service details, estimated timelines, and materials used will be explained in writing or during your consultation.

2. Pricing, Estimates, Deposits, and Payment Terms

  • All pricing is customized based on your specific vehicle, service type, and required labor. Quotes are provided after evaluation and do not include applicable taxes, shop fees, or third-party costs unless explicitly stated.
  • Written or verbal estimates are valid for 30 days.
  • Pricing is subject to change due to unforeseen conditions (e.g., excessive contamination, poor previous installs, etc.).

Deposits may be required to secure your appointment or initiate product ordering. A deposit is a partial prepayment that holds your reserved time on our schedule and may be used to cover material costs.

Refunds on deposits will follow the structure below:

  • If canceled at least 7 full days before the appointment, your deposit is refundableminus any non-returnable product costs that have already been ordered for your job.
  • If canceled within 7 days of the appointment, your deposit is non-refundable due to late notice and lost booking time.
  • If Kickin’ Customs cancels, your deposit will be refunded in full.

We reserve the right to require proof of cancellation timing in writing. All material-related deductions will be itemized upon request.

Advance Payments may be required for purchases involving special-order products, premium materials, or high-cost labor commitments. An advance payment is a partial payment of the total service cost used to initiate preparation or cover non-refundable material expenses.

Refunds on advance payments follow the same policy as deposits: – If canceled at least 7 full days before the appointment, we will refund your advance payment minus any non-returnable product or labor costs already incurred. – If canceled within 7 days of the appointment, your advance payment is non-refundable. – If Kickin’ Customs cancels, your advance payment will be refunded in full.

We reserve the right to retain proof of costs, time invested, or product non-returnability before issuing any partial refund.

Full payment is due upon completion of the service unless otherwise arranged in writing. Financing options may be available and are subject to approval.

3. Cancellations, Rescheduling, and No-Show Policy

  • Appointments must be canceled or rescheduled 48 hours in advance.
  • Missed appointments, late cancellations, or no-shows may forfeit your deposit and could be subject to a rebooking fee.
  • Kickin’ Customs reserves the right to cancel or reschedule any appointment at its sole discretion due to weather, emergencies, operational limitations, material unavailability, suspected fraud, or other unforeseen circumstances. You will be notified immediately, and any deposit or advance payment will be refunded in full.

4. Refund Policy

All sales are final once a service is performed. No refunds will be issued for completed work unless required by law. If there is a concern with the final result, contact us within 5 business days. We reserve the right to inspect and attempt to remedy any issues before any other action is taken.

5. Workmanship Guarantee and Manufacturer Warranties

  • We offer a 1-year workmanship guarantee covering installation-related defects.
  • Manufacturer warranties (e.g., from XPEL or other suppliers) are honored directly through those companies and follow their official terms and conditions.
  • Warranties are void if maintenance guidelines are not followed or if damage results from impact, neglect, or third-party interference.

6. Vehicle Condition and Customer Responsibilities

  • Vehicles must be delivered in clean, dry, and ready-to-work condition unless detailing is part of the service.
  • Customers must disclose any aftermarket paint, body work, previous installations, or sensitive surfaces.
  • We are not liable for pre-existing damage or failures caused by compromised paint, rust, corrosion, prior poor installs, or hidden defects.
  • Kickin’ Customs is not responsible for any valuables or personal items left inside the vehicle.

7. Media Release Consent

By booking services with Kickin’ Customs, you consent to photographs and videos of your vehicle being taken and used in marketing, advertising, training, and social media. If you wish to opt out, please inform us in writing before your appointment.

8. Prohibited Website Uses

You agree to use this Website in full compliance with all applicable local, state, and federal laws and these Terms. The following is a non-exhaustive list of prohibited uses. You agree that you will not:

  • Impersonate or attempt to impersonate Kickin’ Customs, its employees, affiliates, or representatives;
  • Misrepresent your identity or affiliation with any person or entity;

These limitations reflect a reasonable allocation of risk and will survive and apply even if any limited remedy fails of its essential purpose. The limitations of liability provided herein inure to the benefit of Kickin’ Customs LLC and its owners, employees, contractors, affiliates, and representatives.

Any dispute arising out of or related to these Terms or services provided shall be brought exclusively in a court located in Bristol County, MA.

You agree to waive the right to participate in any class action and may only bring claims in your individual capacity.

These Terms constitute the entire agreement between you and Kickin’ Customs LLC.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. Changes will be posted with an updated effective date. Continued use of the Website or services after changes implies acceptance.

21. Warranty Limitations on Purchases

Unless otherwise stated in writing, all items and services sold or displayed by Kickin’ Customs LLC are provided “as is.” This means no additional warranties are offered beyond:

  • Our 1-year workmanship guarantee (covering defects in installation workmanship)
  • Any applicable manufacturer warranties, which must be registered and claimed through the manufacturer directly

We do not provide implied warranties for merchantability, fitness for a specific use, or longevity of any product or material. Warranty claims based on misuse, neglect, third-party damage, environmental exposure, or improper maintenance are not covered.
